Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Complainant’s Submission and Presentation:
I received €80 in the first week, €60 second week, €40 third week and €20 in the fourth week and thereafter €20 cash per week until cessation of employment. |
The owner said he would take me as an apprentice mechanic under the FAS apprenticeship scheme. I never received any contract in writing despite numerous request. |
I did not receive any holiday nor paid during public holidays. I was on one occasion was docked €10 for week which fell on a public holiday. |
Respondent’s Submission and Presentation:
The Respondent denied all claims at the Hearing.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act. As the claimant was not present at the Hearing to present his evidence and the Respondent totally denied the claims I find the claims not well founded.
