Preliminary issue:

Appeals of a Rights Commissioner decision must be submitted to the secretariat of the Employment Appeals Tribunal within 6 weeks of said decision being communicated to him.

The Rights Commissioner issued a decision on 30^th January 2015 and the appeal was lodged by the appellant with the Tribunal on 23^rd March 2015. Accordingly, the Tribunal has no jurisdiction to hear the appeal under the Payment of Wages Act 1991 and Terms Of Employment (Information) Act 1994 to 2012.
