The decision of the Tribunal was as follows:-
This case came to the Tribunal as an employee appeal under the Payment of Wages Act, 1991, against Rights Commissioner Decision r-150148-pw-14/JW in which it was decided that the complaint failed for want of prosecution after neither side attended the scheduled hearing. The employee told the Tribunal that he had been away on the day of hearing.
The employee appealed on the grounds that he was owed wages and his boss was now deceased. He told the Tribunal that his employment ended at the end of September 2014 and that he was still owed three weeks’ pay.
No evidence was proffered by or on behalf of the respondent.
Determination:
On the uncontested evidence of the appellant the Tribunal allows the employee appeal under the Payment of Wages Act, 1991, against Rights Commissioner Decision r-150148-pw-14/JW and awards the appellant the sum of €1,377.00 (this amount being equivalent to three weeks’ gross pay at €459.00 per week) under the said legislation.
