The decision of the Tribunal was as follows:
The name of the respondent was amended at the outset of the hearing as confirmed by the Director of the company (BE).
The claimant told the Tribunal that he was transferred from Company B to the respondent company. He had been paid 2.8 years in terms of a redundancy payment but it currently owed a balance of €9,500 having already received €3,588. The respondent stated that he is struggling financially and accepted that the appellant is owed a balance of €9,500.
Determination
Based on the evidence adduced, the Tribunal finds that the appellant is entitled to a redundancy lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of commencement: 17th August 2004
Date of termination: 16th February 2015
Gross weekly pay: €600
As it has been agreed that a payment of €3,588 has already been paid, the Tribunal awards the balance due of €9,500.
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
