Determination
The Tribunal is satisfied that the respondent was properly put on notice of this hearing, yet they failed to attend. The appellant became aware that the company was in financial difficulty when his wages were paid late for a number of months. The appellant was on sick leave and when he went to the Social Welfare office in May 2015 he discovered that the respondent had lodged a P45 for him in March 2015 and had made him redundant.
Based on the uncontested evidence of the appellant, the Tribunal find that the appeal under the Redundancy Payments Acts 1967 to 2007 succeeds and awards the appellant a redundancy lump sum based on the following;
Date of Commencement: 01 August 2011
Date of Termination: 13 May 2015
Gross Weekly Pay: €636.73
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
Please note a statutory ceiling of €600.00 applies to all payments from the Social Insurance Fund.
