Procedure:

In accordance with Section 41(4) of the Workplace Relations Act, and Section 13 of the Industrial Relations Act, 1969 – 2001 and following the referral of the complaint to me by the Director General, the Hearing was scheduled for 30^th March 2016.

Section 4(1) of the Industrial Relations Act, 1946 defines a “worker” as follows: “In this Act…. The word “worker” means any person of the age of fourteen years or upwards who has entered into or works under a contract with an employer…………, other than-(a) A person who is employed by or under the State”

The Complainant is a Civil Servant employed by the State. Therefore I do not have jurisdiction to hear this complaint.
