The decision of the Tribunal was as follows:-
Determination:
At the outset the respondent conceded the claim but stated that she had an inability to make the payment due to the financial state of the her business which had since closed.
Loss having been established the Tribunal awards the following payments under the Minimum Notice and Terms of Employment Acts, 1973 to 2005:
Claimant 1: The sum of €630.52, this being the equivalent of four weeks pay,
Claimant 2: The sum of €689.40, this being the equivalent of two weeks pay full pay of €233.55 and two weeks wages at €111.15 as employment was secured within two weeks of her employment terminating.,
Claimant 3: The sum of €1,134.00, this being the equivalent of four weeks pay,
Claimant 4: The Tribunal are satisfied Claimant 4 was properly notified of the date, time and location of this hearing. Neither she nor a representative on her behalf were in attendance. Accordingly, her claim under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 fails for want of prosecution.
