The decision of the Tribunal was as follows:-
Summary of Evidence
The respondent had serious cash flow problems because many of his customers were slow to pay him. As a result of this the appellant was only being paid “in dribs and drabs” and sometimes the respondent paid him from his own pension. The appellant could not continue in the employment and left. The respondent ceased trading sometime after.
Determination:
The Tribunal is satisfied that a redundancy situation within the meaning of section 9(1)(c) of the Redundancy Payments Acts, 1967 to 2007 existed. Accordingly, the appellant is entitled to a redundancy lump sum payment under the Acts based on the following details:
Date of commencement: 01 January 1998
Date of termination: 08 August 2014
Gross weekly pay: €500.00
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
