Determination
It was agreed between the respondent and the appellant on a previous occasion that the appellant was dismissed by way of redundancy. The RP50 form was not completed correctly by the respondent which has resulted in this case coming before the Tribunal.
The Tribunal are satisfied that the respondent was properly put on notice of this hearing. Based on the uncontested evidence of the appellant, the Tribunal find that the appeal under the Redundancy Payments Acts 1967 to 2007 succeeds and awards the appellant a redundancy lump sum based on the following;
Date of Commencement: 01 November 1993
Date of Termination: 12 December 2014
Gross Weekly Pay: €1,153.84
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period. Please note that there is a statutory ceiling of €600.00 on all payments from the Social Insurance Fund.
The Tribunal find that the appeal under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 succeeds and awards the appellant €9,230.76, being the equivalent to 8 weeks’ pay in lieu of notice.
