The decision of the Tribunal was as follows:-
The respondent is a construction company in which the appellant worked as a foreman. In or around May 2014 the appellant and three other members of staff were informed that work was scarce and were placed on lay-off.
Approximately four weeks later the respondent contacted the four members offering work. Three returned to work but the appellant did not. In August the appellant sent a letter, by registered post, to the respondent looking for statutory redundancy. The letter was never collected by the respondent.
Having heard all the evidence The Tribunal is satisfied that the appellant was not dismissed by reason of redundancy and, accordingly, under the Redundancy Payments Acts, 1967 to 2007, the appeal fails.
