The Tribunal is satisfied that the respondent was duly notified of the hearing.
Appellant’s Case
The appellant’s evidence was that on 22 January 2015, the respondent informed her that the company was continuing with fewer employees as and from 23 January 2015 and that as a result her position was being made redundant on 23 January 2015. Form RP50 was signed by the employer and the appellant.
Determination:
The Tribunal is satisfied that a redundancy situation within the meaning of section 7(2)(c) of the Redundancy Payments Acts, 1967 to 2007 existed. Accordingly, the appellant is entitled to a redundancy lump sum payment under the Acts based on the following details:
Date of commencement: 5 September 2006
Date of termination: 23 January 2015
Gross weekly pay: €316.46
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
