Background:
The Tribunal provided a Polish translator for the hearing.
The respondent came to employ the appellant due to a transfer of undertaking. The respondent was forced to close the business in May 2014 when he was issued with a notice from the landlord.
Determination:
The Tribunal finds that the appellant is entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of Commencement: 11 May 2006
Date of Termination: 16 May 2014
Gross Weekly Pay: €135.00
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
The Tribunal also finds that the appellant is entitled to the sum of €540.00 (being the equivalent of four week’s gross pay) under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
