Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Complainant’s Submission :
On 13 October, 2015, The Complainant made a complaint to the WRC based on a shortfall of annual leave owed to him under the Organisation of Working Time Act 1997.He also claimed a weeks pay in lieu of notice when he left his position as a Baker on 13 April , 2015. |

Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act .
The hearing was arranged for 10.30 am on 15 December, 2015. The Respondent was represented by the Company Director. I allowed time for the Complainant to arrive and the requested Interpreter to link with him. I am satisfied that both parties were notified of the Hearing by the WRC. The Company Director of the Respondent Company attended the Hearing .
Further efforts were made to contact the Complainant on the phone number submitted on the claim form. At 11.00 am, I proceeded to convene the Hearing. In the absence of the Complainant, and having made all reasonable efforts to contact him, I found that the complaint fell for want of prosecution by the complainant .
