Complaint seeking adjudication by the Workplace Relations Commission under section 6 of the Payment of Wages Act, 1991 | CA-00000810-001 | 12/11/2015 |
Date of Adjudication Hearing: 20/01/2016
Workplace Relations Commission Adjudication Officer: Kevin Baneham
Commission Adjudication Officer: Kevin Baneham
Procedure:
In accordance with Section 41(4) of the Workplace Relations Act following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The complaint is made under the Payment of Wages Act and the complainant claims unpaid wages. He also raises issues regarding annual leave and the circumstances around the end of the employment relationship.
The complaint was scheduled for adjudication on the 20th January 2016. The parties were notified of the time and location of the adjudication hearing. Two representatives attended on behalf of the respondent. There was no attendance or appearance by or on behalf of the complainant.
In an email of the 18th January 2016, the complainant said that he did not have his own transport and that he might not be able to attend on the 20th January 2016. There was no request for an adjournment.
Given that the complainant did not attend to present his case at adjudication, the complaint fails for want of prosecution.
Complainant’s Submission and Presentation:
Not applicable as the complainant did not attend the hearing to advance the complaint.
Respondent’s Submission and Presentation:
Not applicable as the complainant did not attend the hearing to advance the complaint.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint fails for want of prosecution by the complainant.
