Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Complainant’s Submission and Presentation:
The complainant had been employed by the respondent as a chef for approximately eight months.
In due course he gave the respondent notice of his intention to leave and eventually did so on November 6th 2015.
He received an email from the respondent on November 18th enclosing his P45 and two payslips which were exhibited in evidence in the amounts of €402.84 and €316.43. However he did not receive any payments for these amounts. He says he has reason to believe that his former employer will not make the payments.
Respondent’s Submission and Presentation:
The Respondent did not attend nor make any submission.
Conclusions and Findings
I find that the complainant has not been paid wages due to him for weeks ending October 30th and November 6th 2015 and that he is due €719.27 on the basis of the payslips sent to him by the respondent..
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Accordingly I award him €719.27 being the wages due to him.
