1. An appeal of a Rights Commissioner's Decision no: r-156069-mw-15/GC.
BACKGROUND:
2. This case is an appeal by the Employer of a Right Commissioner Decision no: r-156069-mw-15/GC. The Rights Commissioner in her Decision of the 28th September 2015 found the Worker's claim well founded. On the 13th November 2015, the Employer appealed the Rights Commissioner's Decision to the Labour Court in accordance with Section 27(1) of the National Minimum Wage Act, 2000. A Labour Court hearing took place on 1st March 2016.
The following is the Court's Determination:
DETERMINATION:
This is an appeal by Denis Lane T/A Fort Elizabeth (the Appellant) against a decision of a Rights Commissioner under the National Minimum Wage Acts, 200 to 2015 in respect of a complaint made by Kryzstof Konefal (the Respondent).
The Appellant did not attend the hearing of the Court. The Court is satisfied that the Appellant was properly notified of the date, place and time of the hearing. No request for a postponement of the hearing in the manner advised in the Court’s correspondence with the parties was made.
The Appeal falls for want of prosecution. The decision of the Rights Commissioner is affirmed.
