This case came before the Tribunal by way of the employer appealing the recommendation of the Rights Commissioner under the Payment of Wages Act 1991 reference r-148167-pw-14/SR and r-149392-pw-14/SR.
The respondent advised the Tribunal in advance of the hearing that he would be unable to attend. The Tribunal heard uncontested evidence from C.E.O. of the appellant organisation.
Determination:
The Tribunal is satisfied that all parties were on notice of the hearing. As there was no appearance by or on behalf of the respondent the appeal by the employer succeeds and the recommendation of the Right Commissioner is overturned.
