The decision of the Tribunal was as follows:-
Determination:
The Tribunal is satisfied that the respondent was properly notified of the date, time and location of the hearing of this matter. Neither they nor a representative on his behalf attended on the day. Having waiting a period of 35 minutes after the scheduled commencement time allotted for this hearing, the Tribunal commenced hearing this matter at 11.05 a.m.
The Tribunal is satisfied that the appellant is entitled to a redundancy payment. Accordingly, the Tribunal finds that the appellant is entitled to a redundancy lump sum under the Redundancy Payments Acts, 1967 to 2007 based on the following criteria:
Date of Commencement: 03 August 2010
Date of Notice: 24 December 2014
Date of Cessation: 24 December 2014
Gross Weekly Wage: €204.31
Loss having been established the Tribunal awards the sum of €408.62, this being two weeks gross wages, under the Minimum Notice and Terms of Employment Acts, 1973-2005.
The Tribunal also awards the sum of €1,225.85, this being 30 days leave, under the Organisation of Working Time Act, 1997.
These awards are subject to the appellant having been in employment which is insurable for all purposes under the Social Welfare Consolidation Act, 2005.
