The determination of the Tribunal was as follows:
Following discussions between the parties the Tribunal was told that a settlement had been reached relating to all claims to their mutual satisfaction. The Tribunal was furnished with those settlement terms and the parties then sought an Order from the Tribunal reflecting that settlement. The parties labelled this as a Consent Order.
In acceding to that joint request and in the absence of the respondent not showing that the dismissal of the claimant was not unfair the Tribunal awards him €22,308.57 as compensation under the Unfair Dismissals Acts, 1997 to 2007, in the agreed terms of the Consent Order..
Accordingly, the Tribunal awards the appellant, as agreed by the parties, €2,560.00 under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 and €320.00 under the Organisation of Working Time Act, 1997.
