Procedure:

In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Complainant’s Submission and Presentation:

The complainant had submitted a complaint regarding his rate of pay and working hours. However he did not attend the hearing.

Respondent’s Submission and Presentation:

The respondent did attend.

Findings.

I am satisfied that the complainant was fully on notice of the hearing and was aware that it would be taking place and the details of time and venue.

He did not offer any explanation for his non –attendance.

Decision:

Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.

In view of the failure of the complainant to attend the hearing to present his case I dismiss the complaint.
