Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Complainant’s Submission and Presentation:
The complainant had referred two cases to the WRC; one related to wages which had been referred for investigation and one in respect of outstanding holidays he said were due to him and which was the only complaint at this adjudication hearing.
He commenced work with the respondent on 7th April 2015 and terminated on December 18th 2015.
In his submission he stated that he got one month’s holidays from October 10th to November 11th and visited his family in South America. He stated that he was not due any more holidays.
Respondent’s Submission and Presentation:
The respondent did not appear.
Conclusion and Findings
No further annual leave is due to the complainant on the basis of his evidence at the hearing and his acceptance that no further holidays are due.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons outlined above I dismiss the claim.
