The decision of the Tribunal was as follows:-
Claims were brought under redundancy and minimum notice legislation against the respondent (JOB) although the paperwork indicated that the claims might have been made more properly against another employer (KMcD).
JOB attended the Tribunal hearing and applied to the Tribunal for the claims against him to be struck out for want of prosecution due to the non-attendance of the appellant at the Tribunal hearing.
The Tribunal allowed thirty minutes for the appellant to arrive but there was no attendance by the appellant.
Determination:
The claims brought under the Redundancy Payments Acts, 1967 to 2007, and the Minimum Notice and Terms of Employment Acts, 1973 to 2005, against the respondent (JOB) fall for want of prosecution.
