In accordance with Section 41(4) of the Workplace Relations Act, 2015 and the abovementioned Act following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Complainant’s Submission and Presentation:
i was placed on lay-off on September 4th, 2015. I was made redundant by my employer on October 30th, 2015. |
The complainant submits that she did not receive her entitlement to statutory minimum notice. She was employed as a child care worker in the period July 12th 1999 to 31st of October 2015. She was paid €429 gross per week and is entitled to 8 weeks minimum notice entitlement under the Act. The respondent has asserted that it is not in a position to pay.
Decision:
I find that the complaint is well founded and hereby declare that the complainant is entitled to payment of her statutory minimum notice of eight weeks pay in accordance with the provisions of the Act.
