Procedure:
In accordance with Section 41of the Workplace Relations Act, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Background:
The Complainant was seeking an independent investigation into allegations of poor customer service by him contained in an email and he felt that the allegations were not properly investigated internally.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Following submissions from both parties, I recommend the following;
That the Complainant is completely exonerated from all allegations made against him in the email dated April 15th 2015. This decision should be contained on his personnel file.
I note the company’s statement that the Complainants role as a Shop Steward will not impact in any way on their view or actions with regard to him as an individual employee of the company. I believe this statement was well intentioned and should be accepted by the Complainant as a bona fide statement with regard to how he will be treated in the future.
