Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Complainant’s Submission and Presentation:

Employed from 2/2/09 to 7/6/16 Business closed down and the Owner refused (was not able to financially) to pay notice period of 4 weeks. I was earning 480.75 Euro per week.

Respondent’s Submission and Presentation:

The Respondent was not present at the Hearing but supplied the Complainant with a letter dated June 12^th 2016 stating he owed the Complainant four weeks’ notice pay but was not in a financial position to pay it.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act. The Complainant was entitled to four weeks’ notice pay due to her service and I award her 1,523 Euro to be paid within four weeks of today’s date.
