Procedure:

In accordance with Section 41(4) of the Workplace Relations Act, 2015 and the abovementioned Act, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Complainant’s Submission and Presentation:

The complainant worked for the respondent in the period 3^rd of February 2014 until the 27^th of January 2016 at which point his employment was terminated without either service credit or payment for entitlement to minimum statutory notice of 1 week. He was paid €9.15 per hour and worked 17 hours per week.

Decision:

Based on the uncontested evidence adduced at hearing I find that the complaint is well founded. The date of dismissal for the purpose of calculation of the complainant’s entitlement to statutory redundancy is 6^th of February 2014. I hereby require that the respondent pay the claimant €771.53 (say seven hundred and seventy one euro and 53 cent) in statutory redundancy payment.
