FULL RECOMMENDATION

1. Dismissal.
BACKGROUND:
2. This dispute concerns the Worker's dismissal claim. The Worker referred this case to the Labour Court on 29th July, 2016, in accordance with Section 20(1) of the Industrial Relations Act, 1969, and agreed to be bound by the Court's Recommendation. A Labour Court hearing took place on 7th October, 2016. The Employer did not attend attend the Hearing.
WORKER'S ARGUMENTS:
3.1. The Complainant submits that the respondent employer dismissed her without warning or explanation.
2. The Complainant submits that the respondent did not outline his difficulties with her nor offer her any opportunity to address any complaints he had with her performance
3. The Complainant submits that she worked in accordance with her contract of employment and discharged her duties diligently and efficiently while employed. She submits her dismissal was wholly unfair and unjustified.
RECOMMENDATION:
The Court notes that the Respondent neither attended the hearing nor otherwise made submissions to the Court on this matter. Accordingly, on the basis of the uncontroverted evidence of the Complainant, the Court finds that she was unfairly dismissed from her employment and recommends that the Respondent pay her compensation in the sum of €5,000 in full and final settlement of this dispute.
The Court so recommends.
