The decision of the Tribunal was as follows:
This case came before the Tribunal where the claimant was seeking implementation of the recommendation of the Rights Commissioner under the Terms of Employment (Information) Act 1994 to 2012, reference r-146173-te-14/EH.
The claimant and respondent attended the hearing and confirmed that the recommendation of the Rights Commissioner was not implemented.
The Tribunal is satisfied that the recommendation of the Rights Commissioner has not been carried out by the respondent in accordance with its terms or at all and it is further satisfied that the prescribed six-week time limit for bringing an appeal against the recommendation has expired and no such appeal has been brought. Accordingly, the Tribunal makes a determination to like effect as the Rights Commissioner’s recommendation that the respondent pays the claimant €1,000 under the Terms of Employment (Information) Act 1994-2001.
