Procedure:
In accordance with Section 41(4) of the Workplace Relations Act 2015 and under Section 39 of the Redundancy Payments Act, 1967 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Complainant’s Submission
The following is a summary of the Complainant’s submission. That she was employed as a hair stylist from the 15th of March 2012 to the 17th of October 2015. That she was paid at the rate of €200 per week and she worked 16 hours per week. That she was let go from her employment by the Respondent on the 17th October 2015 and she was not paid her statutory redundancy entitlements contrary to the terms of the Redundancy Payments Act, 1967.
The Respondent did not attend at the hearing.
Findings:
The Complainant was unable to provide details of her entitlements under the Redundancy Payments Act, 1967 at the hearing. The adjudicator allowed a period of six weeks for her to furnish all information relevant to her complaint. The Complainant has failed to provide any information to date to the adjudicator.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Based on the evidence presented a the hearing and the fact that the Complainant failed to provide any information relating to the details of her complaint taken under The Redundancy Payments Act, 1967 I find that this complaint is not well founded and therefore fails.
