Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background.
The Complainant was employed from 22nd July 2015 until the termination of the employment on 2nd October 2015. The Complainant was paid €585.00 gross per week and he worked 39 hours a week. The Complainant referred a complaint to the Workplace Relations Commission on 6th December 2015 alleging the Respondent had breached Section 3 of the Act.
Summary of Complainant’s Position.
The Complainant stated at the Hearing that he was paid €585.00 per week (€15.00 an hour). He stated that he was not given a written statement of his Terms and Conditions of Employment. He stated that he had requested this on a number of occasions but had not been provided with one.
Findings.
Section 3 of the Terms of Employment (Information) Act, 1994-2015 requires an Employer to provide the employee with a written statement of Terms and Conditions of Employment as specified at Section 3 of the Act.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
In accordance with Section 41 (4) of the Workplace Relations Act, 2015 and Section 7 of the Terms of Employment Act, 1994-2015 and on the uncontested evidence of the Complainant I declare the complaint is well founded. I order the Respondent to pay the Complainant compensation of €500.00 within 42 days of the date of this Decision.
