Procedure:

In accordance with Section 41(4) of the Workplace Relations Act, 2015 and Section 6 of the Payment of Wages Act, 1991, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Decision:

The complainant sought a pay rise which he contended was agreed by the employer but not paid.     He did not attend the hearing to prosecute his claim.   The Workplace Relations Commission Adjudication Service offered him the opportunity to request a postponement of his hearing. He indicated in an email to the Service that he had emigrated to Spain and was not in a position to advise when he could attend a hearing.   In those circumstances I deem the complaint fails due to lack of prosecution.
