EMPLOYMENT APPEALS TRIBUNAL
CASE NO.
RP396/2015
APPEAL OF:
Michael Franklin
-Claimant
against
Cluas Centre Limited
-Respondent
under
REDUNDANCY PAYMENTS ACTS 1967 TO 2007
I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms M. Levey B.L.
Members: Mr. M. Noone
Ms N. Greene
heard this appeal at Dublin on 26th August 2016
Representation:
Appellant: In person
Respondent: Mr. Greg Ryan solicitor. G. Ryan solicitors, 9 upper Mount Street Dublin 1
Determination:
The Appellant told the Tribunal that he had received his redundancy lump sum payment. He was appealing the manner or procedures that were followed by the Respondent. He said that he did not get formal notice of two weeks, although he was paid in lieu of notice. The representative for the Respondent explained that nobody has been taken on to fill the Appellant’s position.
The Tribunal determines that the position was redundant. There was a genuine redundancy situation in this case. The appeal under the Redundancy Payments Acts, 1967 To 2007 succeeds. It also notes that the Appellant stated that he has received his redundancy lump sum payment.
