The determination of the Tribunal was as follows:-
Determination:
As there was no appearance by or on behalf of the claimant the Secretary to the Division of the Tribunal telephoned the solicitor who had been on file for the claimant. That solicitor was on maternity leave and another Solicitor had taken over the case. She requested her apologies be conveyed both to the Tribunal and the respondent for her non-appearance at the hearing. She had become aware that the claimant was now abroad. She had emailed him several times but was unable to receive instructions in the case.
In the circumstances, the Tribunal dismisses the claim under the Unfair Dismissals Acts, 1977 to 2007 for want of prosecution.
