Procedure:

In accordance with Section 41(4) of the Workplace Relations Act, 2015 and the abovementioned Act, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Complainant’s Submission and Presentation:

The complainant submits that she is owed her wages for June 2016, latter part of May 2016 and holiday pay due on cessation in the amount of €2,516 net

Respondent’s Submission and Presentation:

The respondent accepts that the wages and holiday pay remains unpaid. He is not in a position to pay it presently.

Decision:

The parties agreed to amend the name of the respondent to “Emarcation Ltd” at the hearing.

There is no dispute in relation to the complainant’s entitlement and therefore I find that the herein complaint is well founded. I hereby require that the respondent pay the claimant €2,561 (say two thousand five hundred and sixty one euro) net in compensation within 6 weeks of the date hereof.
