Determination:
There was no appearance by the claimant and his representative told the Tribunal that the claimant had not got a visa to return to this jurisdiction. The claimant is currently residing in his homeland.
The claimant’s representative had no instruction as to whether the claimant had made an application for a visa and could give no insight as to whether he would ever apply or be granted one.
In view of the fact that the claimant did not attend the hearing and gave no commitment to ever being available to attend a hearing the Tribunal finds it has no option but to dismiss this case for want of prosecution.
