EMPLOYMENT APPEALS TRIBUNAL
APPEAL OF: CASE NO.
Michael McEntee - Appellant PW240/2015
Against the recommendation of the Rights Commissioner in the case of:
Mala HR T/A Midpoint HR International - Respondent
Under
PAYMENT OF WAGES ACT 1991
I certify that the Tribunal
(Division of Tribunal)
Chairman: Mr. T. Ryan
Members: Mr M. Noone
Mr N. Dowling
heard this appeal at Dublin on 10th November 2017
Representation:
Appellant: The appellant in person
Respondent: No appearance by or on behalf of the respondent.
Background:
There was no appearance by or on behalf of the respondent and the Tribunal is satisfied that the respondent was properly notified of the hearing.
The appellant gave evidence in respect of his claim under the Payment of Wages Act, 1991. He commenced employment with the respondent on 1st April 2014 and his employment terminated on 18th July 2014. The appellant was paid for the first month of his employment but received no payment thereafter. On commencement of employment the appellant received a written contract of employment which set out his terms and conditions of employment and a copy of this was submitted to the Tribunal. The appellant was to be paid on a monthly basis but never received pay slips.
The appellant held that he was due €6,446.25 in unpaid wages.
Determination:
Having considered the uncontested evidence of the appellant the Tribunal is satisfied that he was not paid wages due to him from the respondent.
Accordingly the Tribunal awards the appellant €6,446.25 under the Payment of Wages Act, 1991.
