Procedure: 

In accordance with Section 13 of the Industrial Relations Act, 1969 and following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute. 

Background

The Complainant has been employed as a General Operative Group 4 Centre Manager with the Respondent. The Complainant referred a dispute to the Workplace Relations Commission on 12^th July 2016 in relation to a grievance she has had with her Employer which she alleged the Respondent had not addressed and the dispute was referred to the WRC.

The Complainant has been on Sick Leave since November 2015. 

Preliminary Issues. 

A number of Preliminary issues arise in relation to this dispute.

1. The Complainant did not present to the Hearing a grievance she had lodged with her Employer. The Respondent clearly stated that no grievance had been lodged

2. The Complainant, along with two of her colleagues notified the Respondent by email on 20^th November 2015 they were removing themselves from their workplace until such time as a meeting was arranged with the HR Department.

3. The Complainant has submitted medical certificates to the Respondent since November 2015 stating she is medically unfit to attend work.

4. Both Parties confirmed there is an agreed Grievance Procedure which the Complainant has not utilized. 

Recommendation

In the absence of a Grievance lodged with the Respondent I am unable to issue any Recommendation as the internal agreed Grievance Procedures have not been utilised by the Complainant.
