Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, and following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background.
The Complainant was employed from 26th April 2016 until the employment terminated on 21st May 2016. The Complainant was paid €11.50 an hour and he worked 40 hours a week.
The Complainant referred a complaint to the Workplace Relations Commission on 8th June 2016 alleging the Respondent had breached Section 5 of the Payment of Wages Act in that he had not been paid for 45 hours due to be paid to him on 26th May 2016.
Summary of Complainant’s Position.
The Complainant stated that he had worked 29 hours between 12th and 19th May 2016 and he had worked 16 hours on 20th and 21st May 2016. He stated he had not been for these hours worked.
The Complainant stated that he had sent an email to his Employer on 31st May 2016 there was no response. He sent a further email on 2nd June 2016 but again there was no response from the Employer.

On the uncontested evidence of the Complainant and in accordance with Section 41(5) of the Workplace Relations Act, 2015, I declare the complaint is well founded. I direct the Respondent to pay the Complainant €517.50, subject to any lawful deductions, within 42 days of the date of this Decision.
