Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Complainant’s Submission and Presentation:
The complainant says he worked for thirteen days in the respondent restaurant. They offered to pay him only for seven of those days and claimed the other six were "training days".
In fact the training days required him to worked for a total of fifty-two hours.
In any event they did not even pay for the days they promised His attempts to contact the employer were fruitless.
He did not attend the hearing.
Respondent’s Submission and Presentation:
The respondent did not attend the hearing.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I am satisfied that both parties had been notified of the hearing and failed to attend without reasonable explanation.
Accordingly I do not uphold complaint CA-00006523-001 which falls for want of prosecution.
