Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background
The claimant, a lorry driver worked for the respondent on the 28th, 30th June’16 and the 4th, 5th, 6th and 8th of July ‘16. He worked an average of 8 to 10 hours per day. He stated that he was promised €120 per day and he was only paid €50 after 3 days. The claimant submitted that he is owed a balance of €670 in wages. He also stated that he received no holiday pay for the 60 hours he worked.
Findings
The Respondent did not attend.
Based on the evidence as submitted I find the claimant worked 60 hours @ 8% he was entitled to 4.8 hours holiday pay. I find that he was entitled to pay of €60 for holidays
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Based on the uncontested evidence I find the complaint to be well founded and I award the claimant €670 in respect of wages and €60 in respect of holiday pay giving a total of €730 amount due to the claimant.
