1. Appeal of Adjudication Officer Decision No.ADJ-00003225.
BACKGROUND:
2. This matter was referred to an Adjudication Officer for investigation and decision. On the 3 October 2016 the Adjudication Officer issued the following Recommendation:-
- While the situation is now complicated by the long term absence of the complainant I recommend that both parties immediately re-engage to resolve the issues between them.
The Employee appealed the Adjudication Officer’s decision to the Labour Court on the 14 November 2016 in accordance with Section 13(9) of the Industrial Relations Act, 1969.
A Labour Court hearing took place on the 19 January 2017.
DECISION:
The Court has considered in detail the written submissions of the parties.
The matter before the Court relates to the operation of the internal systems of the Respondent and any determination by the Court could only have meaning in the context of the Appellant’s employment with the Respondent.
It is common case that the Appellant resigned his employment with the Respondent on the 10October 2016. The Court considers the matter, in the circumstances, to be moot.
The Court so determines.
