1. Appeal of Adjudication Officer's Decision

2. The Claimant appealed the Decision of the Adjudication Officer to the Labour Court in accordance with the terms of the Redundancy Payments Acts, 1967 to 2014. A Labour Court hearing took place on 4th January, 2017. The following is the Determination of the Court:
DETERMINATION:
This matter came before the Court by way of an appeal of a decision made by an Adjudication Officer in a complaint made by Tomas Bunokas (the appellant) against his former employer iDrink Distribution Limited (the Respondent) under the Redundancy Payments Act, 1967 - 2014 (the Act).
The Respondent did not, for stated reasons, attend the hearing of the Court.
Determination
The Court determines, in accordance with the Act at Section 39A, that the Appellant having service of greater than 104 weeks inclusive of his entitlement to statutory notice upon termination of his employment in February 2016, is statutorily entitled to a Redundancy Lump Sum payment of €1,750 in accordance with the Act at Section 19 and Schedule 3. The decision of the Adjudication Officer is set aside.
The Court so determines.
