The determination of the Tribunal was as follows:-
History:
On the morning of the scheduled hearing, the 12th of December 2016, the claimant’s representative emailed the Secretariat stating “it was necessary for us to apply for an adjournment of this matter….” Following a telephone conversation with a secretary from the Secretariat a further email from the claimant’s representative outlined in some detail why the need for a postponement arose. The representative for the claimant was informed it was a matter for the division of the Tribunal who were listed to hear the matter at 2.30p.m. to decide on the written application.
Determination:
The Tribunal is satisfied that the claimant was properly notified of the date, time and location of the hearing of this matter. Neither he nor a representative on his behalf attended on the day. The Tribunal took note of the contents of the emails submitted by the representative for the claimant and refused the written application to postpone the matter.
Having waiting a period of 10 minutes after the scheduled commencement time allotted for this hearing, the Tribunal commenced hearing this matter at 2.40p.m.
The Tribunal determines these claims under the Unfair Dismissals Acts, 1977 to 2007 and the Minimum Notice and Terms of Employment Acts, 1973 to 2005 fail for want of prosecution.
