Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969 following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
The Complainant was employed as an Accounts Executive from 3rd January 2017 to 13th February 2017. He was paid €1,980.00 net per month. He has claimed that he had to leave his employment due to the conduct of his employer. The Respondent has rejected this claim. |
Summary of Complainant’s Case:
The Complainant did not attend and was not represented. No complaint was prosecuted. |
Summary of Respondent’s Case:
The Respondent is a Hong Kong based company, they sought to respond by written submission. This was acceded to and they sent in a written submission. |
Findings and Conclusions:
I note correspondence on the file advising both parties of the venue, date and time of the hearing. I note that the Respondent supplied a written statement in response to the complaint. I note that the Complainant did not attend, was not represented and made no submission. I find that no complaint was prosecuted on the day. |
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
I recommend that as no complaint was prosecuted at the hearing the complaint fails for want of prosecution. |
