Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Background:

The claimant was employed by the respondent from the 3^rd to the 14^th November 2016. He stated that it was agreed that he would get paid €527.14 gross for a 35 hour week. He stated that on the 14^th November he contacted the respondent and informed him that he would not be coming back to work. It was stated that the respondent agreed to forward his P45 along with his outstanding wages. Despite repeated request and correspondence the respondent has failed to pay him. The claimant is seeking €738 gross in wages and €59.03 in holiday pay making a total of €797.03 gross which is due to him.

Findings:

The respondent did not attend.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.

Based on the uncontested evidence I find the complaint to be well founded and I award the claimant €797.03 gross.
