Determination:
There was no appearance or representation for or on behalf of the Respondent. The Tribunal is satisfied that proper notification was sent to the Respondent. The representative of the Respondent did courteously write to the Tribunal to say that they would not be in attendance.
The claimant explained that worked as a barman in the Respondent and then as a bar manager.
He took ill in work one day and was brought to hospital where he stayed for five days. When he got out he contacted KB who co-owned the Respondent bar and he was told to contact someone else. He was told that there were no hours for him to work. He was told to keep in contact which he did. He eventually received his form p45.
Accordingly, having heard the uncontested evidence of the claimant and evidence as to his loss the Tribunal awards the claimant the sum of €25,220.00, under the Unfair Dismissals Acts, 1977 to 2015.
Under the Minimum Notice and Terms of Employment Act 1971 to 2015, the Tribunal awards the claimant the sum of €480.00, this being one week’s gross pay.
