In accordance with Section 41(4) of the Workplace Relations Act, 2015 [and/or Section 8(1B) of the Unfair Dismissals Act, 1977, and/or Section 9 of the Protection of Employees (Employers’ Insolvency) Act, 1984, and/or Section 79 of the Employment Equality Act, 1998, and/or Section 25 of the Equal Status Act, 2000] following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Complainant’s Submission and Presentation:
There was an unexplained absence of the Claimant.
I commenced work for the Respondent on 20/5/16. I agreed a rate of pay of €9.25 per hour, rising to €10 per hour after one month and to €10.50 after 3 months. On 20/5/16 I worked from 9am to 7pm (although my timesheet incorrectly states 10am to 3pm). On 21/5/16 I worked from 9am to 5pm. On 23/5/16 I worked from 9am to 5pm, although there is a not on my timesheet stating that I will only be paid for 6 hours, although hours worked are recorded as above. I worked cleaning and doing some other tasks at various apartment block locations in and around Dublin. My employer advised me that I would be paid on 27/5/16 but has not done so. I ceased employment on 23/5/16 due to non-payment of wages |

Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
As there was an unexplained absence of the Claimant the claim fails for lack of prosecution.
