Procedure:

In accordance with Section 41 (4) of the Workplace Relations Act, 2015 and following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Preliminary Issue.

This complaint was submitted to the Workplace Relations Commission on 8^th September 2016 under Regulation 6 of the European Communities (Protection of Employment) Regulations 2000. The submission at the Hearing was in relation to the payment of redundancy to the Complainant on termination of her employment on 6^th July 2016.

Decision:

Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act. I declare I do not have jurisdiction to hear a complaint under these Regulations in relation to payment of Redundancy entitlements under the Redundancy Payments Act, 1967.

The Complainant has indicated her intention to lodge a complaint under the Redundancy Payments Act, 1967
