1. Appeal of Adjudication Officer's Decision
BACKGROUND:
2. The Worker appealed the Decision of the Adjudication Officer to the Labour Court on 21st September 2016. A Labour Court hearing took place on 16th March 2016.
DECISION:
Background to the Appeal
This is the Worker’s appeal under section 13 of the Industrial Relations Act 1969. It came before the Court in conjunction with an appeal brought by the Worker from a decision of an Adjudication Officer under the Safety, Health and Welfare at Work Act 2005. Both claims/appeals are inextricably linked. The Court has dealt in some detail with the factual background to the underlying issues in case HSC/16/11. It is not necessary to repeat that background in this recommendation.
Recommendation
Having considered in detail the verbal submissions of the parties, the Court upholds in full the Recommendation of the Adjudication Officer.
The Court so recommends.
