Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 [and/or Section 8(1B) of the Unfair Dismissals Act, 1977, and/or Section 9 of the Protection of Employees (Employers’ Insolvency) Act, 1984, and/or Section 79 of the Employment Equality Act, 1998, and/or Section 25 of the Equal Status Act, 2000] following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Complainant’s Submission and Presentation:
On 19-May I had a call to go to work if I’m free for the Respondent. He came to take me with his van at 14:30 and went to one address, to another one. I finished work at 20:50.On 20-may I was at 9 at the office. Then we went to 3 addresses, I finished work at 18:25.Then he said that on Monday I must be at the office at 9 to start working. On 23-may I went at 9 o clock and Austin came at 11. My colleagues told me that he is still not paying them for the last weeks. When the employer came they said that they will not work, if he is not paying them. In this day I understood that he will pay only for the hours of cleaning, and he will not pay for traveling from one place to other. He doesn’t give me any contract and I told him that I cannot work like this. (Without contract, without gloves.)Austin said that he will pay me on 27 Friday, for this 2 days. He gives me timesheet to fill it after the days that I worked. Now is 30 May and I still got no money for the days I worked. |

There was an unexplained absence of the Respondent.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
As there was an unexplained absence of the Respondent I accept the uncontested evidence presented by the Claimant. I find the claim well founded and award €129.00
